Do You Need a Permit for a Bathroom Renovation in Kitchener?

Short version: no permit for a like-for-like refresh, a building permit from the City of Kitchener Building Division the moment plumbing moves or walls change, and an ESA permit for any new electrical. Here is the line, and why it matters when you sell.

Permits are the part of a bathroom renovation nobody gets excited about, and the part that comes back to bite you at resale if they were skipped. The rules in Kitchener come from the Ontario Building Code, administered locally by the City of Kitchener Building Division, plus the Electrical Safety Authority for anything electrical.

No permit needed

Replacing a vanity, toilet, tub, faucet or shower head in the same location
New tile, flooring, paint, mirror, accessories
Replacing the exhaust fan with a like-for-like unit on the existing circuit and duct
Swapping a light fixture on an existing box

This covers most cosmetic refreshes and a fair number of full remodels, as long as every fixture goes back where it came from.

Building permit required

Moving or adding plumbing fixtures: relocating the toilet, adding a second sink, moving the shower drain
Removing, moving or adding walls, including opening a wall to enlarge the bathroom
Adding a new bathroom where there was not one, including a basement bathroom
Structural work of any kind, such as a new window opening or a beam

The permit application goes to the City of Kitchener Building Division with a simple drawing of the existing and proposed layout. Turnaround for a residential bathroom is usually measured in days to a couple of weeks. Plumbing rough-in and final inspections are booked as the job progresses; your contractor should handle all of it.

ESA electrical permit

Electrical is separate from the building permit. Any new circuit, new outlet, new pot lights or a heated-floor system needs a permit and inspection through the Electrical Safety Authority, filed by a licensed electrical contractor. A GFCI outlet by the sink and a dedicated fan circuit are standard on a full remodel, so most full remodels involve an ESA permit even when no building permit is needed.

Three things. First, a home inspector or a buyer's lawyer can ask for permits on any visible renovation, and unpermitted plumbing or electrical work is a negotiating lever against you. Second, insurance claims involving unpermitted work get complicated. Third, the City of Kitchener Building Division can require the work to be opened up for inspection after the fact, which means tearing out finished tile. None of this is worth saving a few hundred dollars on the permit.

The tell: a contractor who says "we do not need a permit" for a job that moves the toilet is either uninformed or planning to keep the job off the books. Either way, it is your house on the line.
